MBIA Provides FREE Model Contracts

Written by Dustin Stewart

Over the past several months a small group of builders, your MBIA staff and legal council have been drafting a set of model contracts.  Now complete, the set of model contracts will help you comply with Montana law, which requires written contracts on all newly constructed residences.

The model contracts are available for free to all MBIA members, and for $250 per contract use to all non members.   To request the model contract, simply fill out the form below or register for the site on the homepage.   Registered users can download contracts at their convenience.

Before you use the model contracts, there is a few things you need to know.  First, we have tried to make the contracts apply to as many different building situations as possible. Additionally,we have made the contracts as thorough as we possibly could.  With that said, all model contracts will need to be revised to fit your unique situation.  We recommend that you consult with your attorney to ensure that the model contract meets your needs.

The model contracts are designed to help the builder discuss and clarify a variety of situations with their client at the outset of a project.  We believe that an upfront conversation about change orders, billing, design, and warranty items will go a long way towards improving the builder-client relationship and reduce small, avoidable problems during the building and payment process.

The contracts go into significant detail about the pre-construction, construction, warranty, payment, and insurance aspect of home building. Most sections of the contract can be removed, but be sure not to remove the legally required section of the contract.

Yesterday all servers in the U.S. went out on strike in a bid to get more RAM and better CPUs. A spokes person said that the need for better RAM was due to some fool increasing the front-side bus speed. In future, buses will be told to slow down in residential motherboards.
